​Non-Residents Tax Returns


Perhaps you are in the US on a work visa, or you have started a company that conducts business in the US. If you have US income, you likely have to file a US tax return.  Depending on your situation, you may owe taxes or can get a refund.  Tax treaties may be available for you to pay less taxes. Failure to pay the correct taxes can result in hefty fines when you leave the US or put your US Green Card in peril.  Easton can help you!



​Form 5472​ - Disregarded Entities by Foreign Owners


Since 2018 foreign owners of US Limited Liability Corporations (Disregarded Entities) are required to report tax Form 5472. In addition the foreign owned US LLC is required to file a pro-forma Form 1120 with Form 5472 attached. This will cover filing obligations for the LLC and its owner.

However, If the LLC holds properties and the properties are used for rental activities, then the foreign owner will report rental activities on form 1040NR under their personal ITIN. Pro-forma 1120 + 5472 still have to be filed as well under the EIN of the LLC.  Forms 1120 + 5472 must be sent to the IRS office located in the state of Utah by mail and cannot be electronically filed.  In order to file Form 5472, all applicable entities will require EINs.

If this is a new LLC, prior to filing Form 5472 the LLC must obtain an EIN by filing Form SS-4. In order to request an EIN, you must first have an ITIN. In order to request an ITIN, Form W-7 must first be filed. Easton assist you with all of the reporting requirements (Forms 5472, SS-4, W-7, and 1120).



IRS Letters and Responses


If you have received letters from the IRS, or if you are an expat and the letter indicates IRS may disallow the Foreign Earned Income Tax Exclusion, don't panic, immediately call Easton!  According to our experience such inquires can be resolved without extra tax dues or penalties.  Easton have handled many such cases.
